INTRODUCTION
The MeitY Startup Hub (MSH) has been established under the aegis of Software Technology Parks of India [(hereinafter called STPI)which is an autonomous body under the Ministry of Electronics and Information Technology (MeitY), Government of India]with a mission to build a conducive innovation and start-up ecosystem by bringing together various technology innovation stakeholders, breaking away with the culture of working in silos and paving the way towards a strong economy built on the twin engines of innovation and disruption. It acts as a hub and ensures synergies among all the Incubation Centers, Centres of Excellence on Emerging Technologies and other existing platforms, supported by MeitY for facilitating crisscrossing of technology resources, sharing best practices and ideas across the entire innovation and start-up ecosystem. The Centre for Development of Advanced Computing (CDAC) is an Autonomous Scientific Society of MeitY that facilitates certain activities and actions of MSH.
MSH with STPI as its Administrator and CDAC as its facilitator strives for excellence in transforming the innovation and start up ecosystem in the country.
PLEASE READ THE FOLLOWING TERMS OF USE AGREEMENT CAREFULLY
The following agreement enunciates and elucidates the mandate and restrictions of use (“Agreement”), applicable to Your use of meitystartuphub.in (“Web Site”), which is a platform to promote startups globally. It is an agreement between You as the user of the Web Site and MSH.
The expressions “You” “Your” or “User(s)” refers to any person who accesses or uses the website for any purpose.
By subscribing to or interacting with other User(s) on or entering into negotiations in respect of any transactions or using the website in any manner for any purpose, You undertake and agree that You have fully read, understood and accepted the Agreement.
If You do not agree to or do not wish to be bound by the guidelines and precepts of the Agreement, You may not access or otherwise use the website in any manner or for any purposes thereof.
Please go through the below mentioned directives carefully. By agreeing to the concerned provisions, acceptance and acknowledgment of the same is implied.
I. NATURE OF WEBSITE AS A PLATFORM/VENUE: LIMITED LIABILITY
The MSH website acts as a binding platform for User(s) consisting of various stakeholders to interact and negotiate with other User(s) for entering into negotiations in respect thereof for any transactions. MSH is not party to negotiations taking place between the User(s) of the Website and is further not party to any agreement including an agreement for any transaction concluded between the User(s) of the website.
All the information available on MSH website regarding startups, incubators, VCs, Angels has been taken from pertinent reliable sources. However MSH does not take any responsibility of accuracy or correctness of data.
While we endeavor to keep information on the portal, up to date and accurate, MSH does not also take any responsibility for any loss arising due to any representation of information on this site. In no event, shall MSH be liable for any direct, indirect, incidental, punitive or consequential damages of any kind whatsoever with respect to the transactions taking place between users.
Users are solely responsible for their decisions of any kind of contract/ transaction on the portal and MSH cannot be held liable for this. Hence Users are advised to verify the accuracy and correctness of data before entering into any kind of transactions or contract.
II. USER(S) ELIGIBILITY AND ONUS OF RESPONSIBILITY
User(s) represent and warrant that they have the right to avail or use the services provided by MSH including but limited to the website. The services of MSH can only be availed by those individuals or business entities, including sole proprietorship firms, companies and partnerships which are authorized under applicable law to form legally binding agreements. As such, natural persons below 18 years of age and business entities or organizations that are not authorized by law to operate in India or other countries are not authorized to avail or use MSH’s services.
User(s) agree to abide by the Agreement and any other rules and regulations imposed by the applicable law from time to time. MSH shall have no liability to the User(s) or anyone else for any content, information or any other material transmitted over MSH’s services, including any fraudulent, untrue, misleading, inaccurate, defamatory, offensive or illicit material and that the onus of such risk of damage arising from such material rests entirely on each User(s).The user shall do its own due diligence before entering into any transaction with other users on the website.
MSH at its sole discretion reserves the right to refuse MSH’s Services to anyone at any time. Such services are not available and may not be availed or used by User(s) whose Accounts have been temporarily or indefinitely suspended.
III. USER(S) AGREEMENT
This Agreement applies to any person who accesses or uses the website for any purpose. User(s) may use this website solely for their commercial/business purposes. This Agreement applies to all services offered on the website and by MSH collectively, with any additional terms and conditions that may be applicable in respect of any specific service used or accessed by User(s) on the Website.
IV. AMENDMENT TO USER(S) AGREEMENT
MSH reserves the right to change, modify, amend, or update the Agreement from time to time and such amended provisions of the Agreement shall be effective immediately upon being posted on the Website. If You do not agree to such provisions, You must stop using the service with immediate effect. Your continuous use of the service shall be deemed to signify and denote Your acceptance to the amended provisions of the Agreement.
V. LINKS TO THIRD PARTY SITES
Links to third party sites are provided on the website as an act of providing convenience of use to User(s). User(s) acknowledge and agree that MSH does not have any control over the content of such websites and/ or any information, resources or materials provided therein. The inclusion of any links does not necessarily imply a recommendation or endorsement on our part of the views so expressed.
MSH may allow User(s) access to websites of third parties through hyperlinks (in the form of word link or otherwise). MSH advises its User(s) to read the terms and conditions of use and/or privacy policies applicable in respect of such Third Party Websites prior to using or accessing such Third Party Websites.
Users acknowledge and agree that MSH has no control over any content offered on Third Party Websites, does not monitor such Third Party Websites and shall in no manner be deemed to be liable or responsible to any person for such Third Party Sites, or any content, products or services made available thereof.
VI. REGISTERED USER(S)
To become a registered User(s) of the Website, a procedure is in place on the Website for the convenience of User(s) so that they can use the website with ease. MSH may refuse registration and deny the login membership and associated User ID and Password to any User(s) for reasons it deems fit. MSH may suspend or terminate a registered membership at any time without any prior notification in the interest of MSH or general interest of its User(s) without assigning any reason thereof and there shall arise no further liability on MSH of any nature due to the suspension or termination of the User account. User(s) registered on the website are in no manner a part of, or affiliated to MSH.
VII. TERMINATION
Content and some of the features on the Website are made available to User(s) free of charge. However, MSH reserves the right to terminate access to certain areas or features of the Website (to registered User(s)) at any time without assigning any reason and with or without notice to such User(s). MSH also reserves the universal right to deny access to particular User(s) to any or all of its services or content without any prior notice or explanation in order to protect the interests of MSH and/ or other User(s) of the Website. MSH further reserves the right to limit, deny or create different access to the Website and its features with respect to different User(s), or to change any or all of the features of the Website or introduce new features without any prior notice to User(s).
VIII. DATA PROTECTION
Personal information supplied by User(s) during the use of the Website is governed by MSH’s privacy policy (“Privacy Policy”). MSH reserves the right to terminate the registration of any User(s) temporarily or permanently at any time for reasons that it deems fit in the best interest of the portal.
IX. POSTED CONTENT AND VIEWS EXPRESSED ON THE WEBSITE
Some content displayed on the Website is provided or (to be) posted by third parties. User(s) can post their content on some of the sections/services of the Website using their login credentials. User(s) need to register for using or availing some of these services. User(s) understand and agree that MSH in such cases is not the author of the content and that MSH has not entered into any arrangement including any agreement of sale or agency with such third parties by virtue of the display of such content on the Website. User(s) further understand and agree MSH is not responsible for the accuracy, propriety, lawfulness or truthfulness of any third party content made available on the Website and shall not be liable to any User(s) in connection with any damage suffered by the User(s) on account of the User(s)’s reliance on such content. Further, MSH reserves the right at its sole discretion, to remove any material/content/images/photos displayed on its Website which it has justifiable reasons to believe, is unlawful/ cause for alarm or distress or could subject MSH to liability or in violation of the Agreement or is otherwise found inappropriate in its opinion.
MSH or STPI assume no onus of liability for any false misleading, frivolous or malicious communication in context of posted content on the Website in case of Normal Users. Further, in case of Stakeholders, the same liability is also not assumed by MSH or CDAC for all purposes thereof.
X. PERSONAL INFORMATION
When personal information (e.g. name, e-mail address, work address, phone numbers and other contact information) are provided through the MSH Website or directly to us by e-mail, you hereby give implicit consent to MSH for processing and administering your personal data to perform all necessary actions to give effect to your request or instructions as well as retaining a record of incoming and outgoing communications (e.g. email) to process your personal data.
Except for information provided by you as explicitly confidential, any information or material submitted shall be deemed to be considered non-confidential and non-proprietary thereby vesting rights in MSH to use, copy, distribute and disclose the same to third parties for any purpose.
XI. RIGHT OF RECTIFICATION OR ERASURE
If MSH holds incorrect information about you which was originally submitted by you through this website, you have the right to have the data amended. Further, you have the right to have any information you have sent to us via this website erased. To request your right to rectification and/or erasure please send your request to meity-sthub@gov.in.
Requests should include: Your name and address and a description of the specific personal data you wish rectified.
XII. INTELLECTUAL PROPERTY RIGHTS
MSH shall be the sole owner and the lawful licensee of all the rights to the Website and its content (“Website Content”). The Website Content implies and includes the design, layout, text, images, graphics, sound, video etc. of or made available on the Website. All title, ownership and intellectual property rights that rest in the Website and the Website content shall remain with MSH and vest in MSH for all purposes thereof.
XIII. TECHNICAL ISSUES
Every possible effort and endeavour shall be made to keep the website running smoothly so that users can access the portal at any given time. However, MSH assumes no responsibility or onus of liability for the website being temporarily unavailable on account of any technical glitches or issues beyond control.
The Site and Services rely majorly on software to function. Whilst we monitor the Site and Services with attempts to fix bugs promptly, MSH does not guarantee that the Site and Services shall be error free or bug free or free from viruses at all times. Any loss caused on account of such virus or bug attack in the system does not hold MSH, STPI or CDAC responsible, liable and accountable for the same.
XIV. SECURITY
Your personal information is held on servers hosted by us or our Internet Service Provider. While the security of your Information is important to us, however, no method of transmission over the Internet, or method of electronic storage, is completely and 100% secure. Therefore, while we strive to use commercially acceptable means to protect your Personal Information, MSH cannot guarantee its absolute security and cannot accept any liability or onus of responsibility where the security of your Personal Information stands compromised or towards the quantum of compromise thereon.
